Step 1: The Labour Agreement (Employer-Led): This is the foundational step that you, as a prospective migrant, do not control but must understand.

  • A Regional Employer Identifies a Need: A business in a DAMA region (e.g., in the Northern Territory, South Australia, or Victoria) has a vacancy they cannot fill with a local Australian worker.
  • The Employer Applies for Endorsement: The employer applies to the regional designator body (e.g., a regional development authority) to have the position endorsed under the relevant DAMA.
  • The Employer Negotiates a Labour Agreement: Once endorsed, the employer applies to the Australian Department of Home Affairs for a labour agreement. This agreement outlines the terms for sponsoring overseas workers under the DAMA.

Step 2: The Visa Application (Your Role): Only after the labour agreement is in place can you, the nominated worker, apply for your visa.

  • You Secure a Job Offer: You must first secure a formal job offer from an approved employer who has a DAMA labour agreement.
  • The Employer Nominates You: The employer formally nominates you for the specific position under the terms of their labour agreement.
  • You Lodge Your Visa Application: You apply for a relevant visa subclass, typically the Subclass 482 Temporary Skill Shortage (TSS) visa initially, with a pathway to the Subclass 186 Employer Nomination Scheme (ENS) visa or Subclass 191 Permanent Residence (Skilled Regional) visa for permanent residency.

The Key Advantage: Understanding DAMA Concessions

The most significant drawcard of the DAMA pathway is the potential for concessions on standard visa requirements. These are not automatic; each regional DAMA has its own list of available concessions.

  • Age Concession: For the permanent Subclass 186 visa, the standard age limit is under 45. Many DAMAs offer an age concession, allowing applicants up to 55, 60, or in some cases, no age limit at all at the time of application for permanent residency.
  • Skill Level Concession: Some DAMAs include occupations that are not on the standard skilled occupation lists (MLTSSL, STSOL, or ROL), or they may allow a lower skill level (ANZSCO Skill Level 3 or 4) than typically permitted.
  • English Language Concession: The standard requirement for a Subclass 482 visa is an IELTS score of 5.0 (or equivalent). DAMAs often lower this, sometimes to an overall score of 4.5 with a minimum of 4.0 in each band, or accept other test types like the OET.

Some DAMAs allow for a lower annual market salary rate, recognising the different wage structures in regional areas, provided it is still above the DAMA-specific TSMIT and is considered a fair market rate for the position.
  • Pathway to Permanent Residency: DAMA provides a structured, clear pathway to permanent residency for occupations that may not have one through other streams, especially for lower-skilled roles.

Eligibility Criteria: Who Can Apply for a DAMA Visa?

  • Occupation: Your profession must be on the eligible occupations list for the specific DAMA you are applying under.
  • Skills and Qualifications: You must have the relevant qualifications and/or work experience required for the role as per the DAMA specifications.

  • English Language Proficiency: You must meet the English requirement, which may be the standard level or a concessional one as per the DAMA.
